Terms & Conditions

Please be aware that while this text is provided in English to avoid any misunderstandings, my other legal documents, including the Privacy Policy and the Imprint, are written in German. This is due to the fact that my company and residence are based in Germany. For an English translation of these documents, you may use translation tools such as Google Translate, DeepL, or ChatGPT. Please note that I do not assume any responsibility for the accuracy or completeness of translations provided by these tools.

Welcome to my website. By booking any service/appointment or donating, you agree to enter into a formal contract and to comply with and be bound by the following terms and conditions. These terms apply to all users of the site and services provided by Leo Brennauer.

For easier readability, ‘1-on-1 Creative Coaching Sessions’ will be referred to as ‘appointments’.

‘Services’ include all other paid offerings.

All services apply only to instrumental tracks; for tracks with vocals, please contact me for availability and a special offer.

Services and Appointments can be booked directly through my website. Please ensure that all information provided during booking is accurate and complete. All service bookings should be made through the buttons and hyperlinks provided. These will indicate the availability of the services. (See Section : Service Limitations and Overbooking Policy)

Services

Payments for services must be made in advance before the service is provided. All prices are quoted in US dollars ($), and payments can be processed via Stripe or by direct invoicing. No taxes are applied to the prices, as I am operating under the “Kleinunternehmerregelung” (German small business regulation) according to § 19 UStG (German Value Added Tax Act).

For payments where Stripe displays a different currency, the respective conversion will be handled by them at the exchange rate shown at the time of payment. I have no control over this conversion process or rate.

Appointments

Payments for appointments should preferably be made prior to the scheduled time, but they must be completed within 7 days after the appointment. Payments can be processed through Stripe or by direct invoice. No taxes apply due to the Kleinunternehmerregelung (German small business regulation) under § 19 UStG.

For payments where Stripe displays a different currency, the respective conversion will be handled by them at the exchange rate shown at the time of payment. I have no control over this conversion process or rate.

 Missing payments

In case of missing payment, a reminder will be sent after 7 days. A late fee of $5 will be applied for every week that payment is delayed beyond the 7-day window. If the payment is still not received, a dunning notice will be issued 14 days later. Should the payment remain outstanding after an additional 14 days, the case will be handed over to a debt collection service. Please note that all costs related to the debt collection process will be borne by the customer.

Important Note

In case of vacation or schedule conflicts, I reserve the right to unilaterally cancel the contract if a booking was still possible during such times. This will, of course, result in a full refund.

Course Refund Policy

Customers may request a refund for purchased courses within thirty (30) days of the purchase date. Refund requests are only eligible if no more than thirty percent (30%) of the course content has been completed or no more than thirty (30) lessons have been started, whichever occurs first. Refund requests must be submitted via email within the thirty (30) day refund period: hello@leo-brennauer.com

Access to the course content is provided immediately after purchase. By accepting my Terms of Use and completing your purchase, you acknowledge that course access begins immediately upon purchase.

If you are a consumer residing in a jurisdiction that grants statutory withdrawal rights, such rights are governed by the applicable laws of your jurisdiction. Nothing in this Refund Policy or these Terms of Use is intended to limit or exclude any mandatory consumer rights that cannot be waived under applicable law.

Track-Length Limitation

All services have a 5-minute track length limit. If you need a longer track, please contact me via the contact form, email, or WhatsApp. If I have room, I’ll provide you with a special offer.

Availability & Booking-Process

All service bookings should be made through the buttons and hyperlinks provided. These will indicate the availability of the services. If someone attempts to book through an old Stripe link despite the availability information, I reserve the right to cancel the booking and retain the Stripe fees.

If a service is currently unavailable, you can sign up for my newsletter to stay informed about when and if the services will be available again.

Service Limitation

Due to time constraints, I reserve the right to limit all services.

Occasionally, technical issues may lead to overbooking. In such cases, I will contact the customer to find a solution. The following options may be considered:

1. Cancellation of the booking without conditions.
2. Rescheduling the booking to the following month.
3. Attempting to fit the booking into an available slot within the current month.

In any case, I reserve the right to unilaterally cancel the contract in the event of overbooking.

Review & Feedback for your music

I reserve the right to cancel the order within 48 hours of receiving payment if I am unavailable due to personal reasons (vacation, illness, etc.) or if a technical error occurs. The total amount will be refunded.

Once the order is received, the client may send their song(s) via WeTransfer or another cloud service provider. Upon receipt, I will provide feedback within 3 days (either in text or video format, depending on the service). The client is guaranteed up to 3 questions answered; beyond that, I cannot guarantee a response depending on availability.

Mastering your music

All rights remain with the original creator and are not affected by the master.

Please note that the Master-Service covers only 1-Track mastering, meaning no stems are required and no additional mixing adjustments will be made. For more detailed work, including both mixing and mastering, please choose the “Mixing & Mastering” service.

Pimping and Enhancing your music

I retain the rights to my modifications. However, with prior agreement and the conclusion of a separate contract, publication can be considered in certain cases

Privacy Policy

Severability Clause

If any provision of these Terms and Conditions is found to be invalid or unenforceable under applicable law, such provision shall be deemed modified to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

Changes to Terms

I reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on my website.

In the event of any disputes arising from these Terms and Conditions, we aim to resolve them amicably through direct communication. Should resolution not be achieved, disputes will be subject to mediation or arbitration as deemed appropriate. Any legal disputes will be governed by the laws of Germany, and the competent courts in Germany will have exclusive jurisdiction.
